Am I Being Violated By My Employer? Is The Company Doing Something Illegal?

Ok there are two things going on:
1) I was promised health insurance benefit. I even believe it’s on my job offer in writing. After my 90 days probation period, I tried to apply but my eployer had no information on it. So I had to wait for the HR Dept. to find out about the plans and prices of the offered plans. As soon as they came to me with the options, I signed up but they told me I missed the deadline (which even the HR director didn’t know existed until the morning she told me that). Now my employer is telling me I will have to wait until May, 2007.
2) My employer is behind 5 or six pay stubs for paychecks to all employees (8 of us, it’s a small company). We know they don’t have pay stubs for us because they are behind on their taxes so they can’t provide a pay stub. I know that if my employer is not paying taxes, they are putting in jeopardy the workman’s comp they are supposed to have. So theoretically, if I get F’d up and need disability, they won’t be able to provide.

    Your employer has a serious cash flow problem and that is a serious issue. It won’t be long before everyone who is owed money comes calling. You better find another job soon.

    Get a new job! It sounds like they’re just screwing you around. Sometimes that’s what happens with small businesses. Anything they can do to save money! As for the insurance deadline, there are usually only a window of time for a company to change, or renew policies, I barely made the cutoff at my work. As for them paying you under the table, it could definitely fck you in the end!

    It’s time to move on-
    Most companies, even small, should of given you a booklet with polices and practices. If you are the first to get health care, then that should worry you.
    Laws vary from state to state and on number 2, they are braking the law.

    not sure; sounds like they are.
    look up the info on your state’s employee website. if they don’t have the money, they could potentially fold and not pay you, unless you take them to court, which will cost you. if i were you, i’d be looking for a different job.
    keep all of this info (including your offer letter) for possible unemployment benefits, if the business closes, or you quit

    I would use this site to start the process! Contact them now… Before you are held responsible for tax that were unpaid for your payroll….

    Don’t quit the job. Wait a bit and then when the company goes out of business you can collect unemployment – and, they will be outta business soon.

    You are being screwed. Go to your state job service like Work Force Services, in Utah. They will help fight for your pay and health insurance, however, ultimately you should get another job.

    I believe you already know the answer to this. Yes you can count on having nothing if they are already do underhanded things with the taxes and not paying ( soon you will be the one not getting paid)

    not only that but you also need to worry about if they are taking taxes out of your checks like they are supposed to do if they dont then you may end up having to pay in at the end of the year b/c of them. Call the small business burrero in your area and ask them what to expect. If i were you i would try to find another job. There is nothing you can do about the insurance though.

    They are going down and you need to jump ship before they sink like the Titanic. You sound intelligent so finding another job shouldn’t be a problem. Get your resume out there ASAP and start interviewing elsewhere.
