I work for the state in the Human Resources department. In order for an employee to get their last check they have to do an exit interview or they dont get it. A lady came in today that worked there for 2 days never went to her work area she was taking the training classes you have to take before you go to your unit. She got another job and left. Today about 2 months later after she had “worked” there she came in to get her check, written on the check said “Needs to Out Process” It was about 10 minutes to closing and the paperwork that she needed to fill out takes up to 45 minutes to do… (yeah it ridiuclous) she really needed her check that day so I gave it to her… I am really scared that I am going to get fired or even go to jail (i’m that paranoid) the people in my office are awfully nit picky mean beeyotches. I am only temporary anyway and am looking for another clerical job (no luck b/c of the economy…)but still I am scared that I am going to go to jail can someone please help me? Tell me what might happen? The lady said she wouldnt tell, but you cant trust anyone at that place… Please help all responses are greatly appreciated. Thanks

I agree, the employer can’t withhold earnings b/c of their policy about exit interviews. Just fess up, tell them she declined to do the interview and you gave her the check. She could file a complaint against the company if she was not given her last check. Exit interviews are dumb for the most part anyways, most companies do not take an honest inventory of anything they have done and rarely change anything based on an employee leaving, mostly just a formality.

2nd: if u still want to work try to ask or share with ur superior before doing something u not sure to do.
3rd : Try another job such as sales it’s very good to u. to be an “open person”
technically they can not hold an employees check for this reason, if the former employee refuses to do the interview they can not refuse to give them their check. you can not be sent to jail you can be disciplined for not following policy but if you wanted to contest it you could probably win. you need to tell your supervisor what happened first thing on monday, explain the lady came in at closing demanded her check and you did not conduct the exit interview. it is done, take ownership for your actions and don’t worry about it. you can not change what has happened and you can not make someone sit through an exit interview on their own time (it is not like this lady was paid to sit there and be interviewed by you)
