Human Resources Won’t Let Me Transfer To Another Department,?

My racist supervisor has written me up twice in 2 months since he heard I was going to transfer to another department. Up until now I had a good employee record. Human resources says I can’t transfer until a year has passed to drop a writeoff from my record. I went to school and got my certificate for this other position now it was all for nothing. Human resources says they have to be fair on all there policy’s (which is understandable) I just feel they should use a little more discretion on the severity of a writeup before holding someone back for advancing their career. Any advice on what I can legally do to fight this. The write ups were my first offense ever.

    If you have a Union, you could file a grievance. But even in that situation, it will probably not do you much good unless you can demonstrate that management is violating the collective bargaining agreement. If you do not have Union representation at your place of employment, there really is not much you can do. If you make a big commotion over this, you are likely to get yourself fired. Your education is not “all for nothing.” Other opportunities will come up.

    Well, first of all you would have to prove without a doubt that your supervisor was racist. Second, you would have to prove you were unjustly written up. Third, the company has a policy in place that seems fair(my opinion) for transferring into another department. You can ask for a meeting between HR, you and your supervisor to see if a compromise can be reached.
