My racist supervisor has written me up twice in 2 months since he heard I was going to transfer to another department. Up until now I had a good employee record. Human resources says I can’t transfer until a year has passed to drop a writeoff from my record. I went to school and got my certificate for this other position now it was all for nothing. Human resources says they have to be fair on all there policy’s (which is understandable) I just feel they should use a little more discretion on the severity of a writeup before holding someone back for advancing their career. Any advice on what I can legally do to fight this. The write ups were my first offense ever.

In a organization there are so many areas that need to have Depts. Legal, Policy/Procedures, Operations and H/R are some of the most important departments. H/R is there to handle unemployment hearings, employee issues, dealing with difficult employee issues and ensuring that all legal requirments are met when terminating employees. Also offering advice to members of management of how to approach difficult employees and ensuring a constructive outcome. When there is effective H/R dept then management can focus on other areas/daily operations meeting goals/quota etc. If your day is absorbed with H/R issues then the daily work gets behind.

Your supervisor, HR Supervisor and acting Director(one in the same) judges people based on their looks, makes inappropriate remarks regarding other associates, discusses any issues regarding you with your other co-workers, and if you are out due to the illness of your child and provide a doctors note, calls the hospital to get information, or calls the doctor, and or have your co-workers call. What happened to HIPPA? Any suggestions?
